1. Acceptance of Terms
By accessing or using the mobile game "Gedya Online" (the "Game"), its website, and all related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). These Services are provided by Yahya Aksakal (operating as Aksakal) ("we", "us", or "our"). If you do not agree to these Terms, you must not access or use the Services.
2. Eligibility and Jurisdiction
- Age Requirement: You must be at least 13 years of age to create an account. If you are under 18, you represent that you have obtained the consent of a parent or legal guardian.
- Governing Law: These Terms and any disputes arising out of or related to the Services shall be governed by and construed in accordance with the laws of Turkey.
- Jurisdiction: Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Istanbul, Turkey, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
3. Account Security and Automated Deletion
You are responsible for safeguarding your account credentials. You agree that:
- Account sharing or trading is strictly prohibited.
- Account Deletion: If you wish to delete your account, you must use the automated deletion tools provided within the Game settings or on our website. We do not process manual deletion requests via email. Once a deletion request is finalized, the process is irreversible after the 30-day retention period.
4. User Conduct and Zero-Tolerance Policy
To maintain a fair environment, the following actions will result in an immediate and permanent ban without prior notice:
- Cheating and Exploits: Using hacks, bots, automation software (macros), or exploiting game bugs for an unfair advantage.
- Abuse and Harassment: Engaging in hate speech, severe toxicity, or impersonating staff members.
- Real-Money Trading (RMT): Buying or selling in-game items, currency, or accounts for real-world money outside of official channels.
- Service Abuse: Any attempt to disrupt the game servers or interfere with the experience of other players.
5. Virtual Items and Licensing
- Ownership: All virtual assets, including but not limited to characters, currency (Gold, Gems, etc.), items, and equipment, are the sole property of Aksakal.
- Limited License: We grant you a limited, non-exclusive, non-transferable license to use these virtual items solely within the Game. You acknowledge that you have no property interest or ownership in these items. We reserve the right to manage, regulate, control, modify, or eliminate virtual items at our sole discretion without liability to you.
6. Payments, Refunds, and Chargeback Abuse
- Final Sale: All purchases made through the Apple App Store or Google Play Store are final. Refunds will only be issued as required by the respective platform policies or applicable local law.
- Chargeback Policy: Any attempt to initiate a fraudulent chargeback or "friendly fraud" through your bank or payment provider will result in the immediate and permanent termination of your account and all associated data.
- No Compensation: You are not entitled to cash or any other forms of reimbursement for unused virtual currency or items when an account is closed, whether voluntarily or due to a violation of these Terms.
7. User-Generated Content (UGC)
We encourage our community to create content. You are granted a limited license to use game footage (screenshots, videos, streams) for non-commercial purposes only (e.g., YouTube, Twitch, Social Media). You may not use our intellectual property for commercial products or standalone businesses without our express written consent.
8. Health and Safety: Photosensitivity Warning
A small percentage of players may experience epileptic seizures or blackouts when exposed to certain light patterns or flashing lights. If you have an epileptic condition, consult a doctor before playing. Immediately stop playing and consult a doctor if you experience dizziness, altered vision, eye or muscle twitches, loss of awareness, or disorientation.
9. Disclaimer of Warranties ("As Is")
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the Game will be uninterrupted, secure, or error-free. We are not liable for any loss of data, items, or progress resulting from server outages, technical failures, or maintenance.
10. Limitation of Liability
To the maximum extent permitted by law, Aksakal shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the Services.
